ACMA Clamping Down on Web Marketing Violations

In February, the ACMA formally warned Select Print Solutions and SThree Australia for email marketing practices that violated the Spam Act. Both companies sent marketing messages without consent and SThree Australia sent messages with no information on unsubscribing.

According to an ACMA e-commerce report released in 2011, online shopping saw a 59 percent increase among adults, up from 53 percent from 2009. With the Internet playing an increasingly important role in peoples' daily lives, the move to online shopping and e-commerce is continuing to rise, leaving traditional brick-and-mortar companies that refuse to adapt with fewer and fewer customers.

A problem some businesses are facing is not knowing when they are violating the Spam Act. The ACMA sends out notices before warnings, although some companies may not be able to act quickly enough.

* When planning an email marketing campaign, remember three words: consent, identify and unsubscribe. A business must have consent to send messages to individuals; messages must have accurate information about the business; and they must include an option for unsubscribing.
* Messages do not have to be sent in bulk to be considered spam.
* Before purchasing marketing lists of email addresses or phone numbers, make sure the information was given with consent by gathering more details from the seller on how the information was acquired.
* The Spam Act applies to email, instant messaging, SMS and MMS text messaging. It does not apply to faxes, Internet ads or voice telemarketing (telemarketing is covered by the Do Not Call Register).
