Equal Treatment to E-Invoicing in France: International Expansion Services Team

France has adopted EU guidelines that furnish equal legal status to both electronic and paper invoices. The provision, defined under "EU Directive 2010/45/EC", has been adopted under French law and is effective in France from January 1, 2013.

Sunnyvale, CA (prHWY.com) March 21, 2013 - The move is expected to reduce complexity, costs and standardize operational procedures making it easier for companies to do business in France. Here are some highlights from Nair & Co., which provides international expansion services for companies setting up foreign operations.
Under the new law, the two existing methods of tax compliant Electronic Data Interchange (EDI) and electronic signatures are both valid. Companies that already have e-invoicing solutions can keep them unchanged.

Companies are also allowed to apply any new technical invoicing solution provided:

* They prepare proper documentation; and
* Assure and establish proper controls and an audit trail of all invoices issued.
* Invoices can be sent in any format (e.g., email content, word, PDF, non tax-compliant EDIs). However, Invoices are considered original only if:

1. The issuers identify can be verified;
2. Integrity of the content is guaranteed i.e. content cannot be altered; and
3. The content is clearly readable

Similar rules are also applicable on storage of e-invoice. If the e-invoices are stored overseas, tax authorities must be given full access to the electronic invoicing system.
