A state court will consider running the state sentence concurrently or during the time you are serving the federal sentence but the federal court will not run their sentence concurrently or while you are serving time on a state sentence. So you would have to wrap up or finish serving your state sentence before you begin serving your federal sentence. In a criminal defense case, many of the laws broken have a punishment attached to them. In some cases, the Federal Government has offered states guidelines for sentencing based on the crimes that are committed. These can include fines that are recommended, as well as jail time that could be appropriate.
RDAP Eligibility - You have to complete RDAP program successfully in order to get the sentence reduction and early release. Usually the most rigorous phase, is the unit-based component comprised of 500-hour worth of therapy lasting approximately 9 months. When completed, you will receive a certificate of completion of RDAP at the end of this phase.
Other phase is considered the follow-up care that you receive if you have not yet been sent to the halfway house. Some graduates complete the RDAP program with time left on their sentence. While still in the general prison population, follow-up services comprise of weekly group sessions and assignments.
Rdap Program Federal Prison - Lasts normally six months and occurs at the halfway house and during home confinement. There are a number of actions which inmates should not take when attempting to influence transfers. Being a management problem tops the list since the case manager will not be interested in doing such inmates favors. Having been convicted of recent disciplinary infractions is also troublesome. Suffice it to say, threatening to cause problems, filing a significant number of frivolous administrative remedies, and refusing to program can harm chances of transfer initiation and approval.
