The RDAP Eligibility Assessment & Positioning Paper prepares our clients for a much more comfortable and less stressful Residential Drug Abuse Program Eligibility Interview held in the client's federal prison setting. We are aware of the key terminology looked at by the Bureau of Prisons drug abuse specialist, and at a minimum, can assure that our clients are going to be reviewed for the RDAP program.
Federal Prison Sentences - In a criminal defense case, many of the laws broken have a punishment attached to them. In some cases, the Federal Government has offered states guidelines for sentencing based on the crimes that are committed. These can include fines that are recommended, as well as jail time that could be appropriate.
Despite their optional nature, as your criminal defense attorney will let you know, many judges tend to follow them. In some cases, the eight amendment of does stipulate additional requirements that a judge must follow and that is where cruel and unusual punishment is forbidden and that can be a tricky area. By definition this would be any punishment that would become excessive for the crime that was committed or seem excessive by the views of most people.
Halfway house time is based on actual time served, not on the total duration of the sentence. Once an inmate becomes eligible for a halfway house, he or she is in no way guaranteed immediate placement. However, especially on sentences of over 12 months, some halfway house time can be expected. Halfway house time is extremely rare on sentences of less than 6 months.
